asylum seekers to Rwanda could be overturned by ministers under new proposals. <\/b><\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The plan, being introduced to Parliament, would allow ministers to ignore the court&#8217;s injunctions.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">It is part of changes to the Human Rights Act, introducing what ministers say will be tougher legal tests.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Critics say the proposals are confusing and would create two tiers of rights that hand more power to ministers.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">But Deputy Prime Minister Dominic Raab said his proposed Bill of Rights fixed problems with the Human Rights Act without abandoning it altogether.<\/p>\n<p>Unveiling the plans, Mr Raab confirmed the government would not quit the European Convention on Human Rights, a set of legal safeguards allowing ordinary people to challenge what they say is unfair treatment by the government.<\/p>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The Bill of Rights also includes measures <a class=\"ssrcss-k17ofw-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-59646684\">proposed last year<\/a>:<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"unordered-list-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<div class=\"ssrcss-1o5f7ft-BulletListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li>a promise to clarify the law for judges so they place British laws above European Court of Human Rights (ECHR) rulings<\/li>\n<li>a plan to screen out some human-rights claims against the government or other public bodies, by requiring people to prove at the earliest possible stage they have suffered a significant disadvantage<\/li>\n<li>a limit on what courts can order public bodies to do to correct a problem caused by a breach of human rights<\/li>\n<li>changes to the interpretation of the right to family life ministers believe will mean more foreign-born offenders can be deported, even if they have children in the UK.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The most significant new proposal &#8211; to ignore ECHR injunctions &#8211; follows last week&#8217;s row over the Home Office&#8217;s abandoned flight to Rwanda.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The Strasbourg court, which is nothing to do with the European Union, issued an injunction blocking the home secretary from putting an asylum seeker on the flight, despite earlier decisions by judges in London not to intervene.<\/p>\n<div class=\"teads-adCall\"><\/div>\n<p>&nbsp;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-18mjolk-ComponentWrapper e1xue1i810\" data-component=\"image-block\">\n<figure decision triggered other appeals and ultimately the cancellation of the flight.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Under the government&#8217;s proposed Bill of Rights, ministers would be able to ignore such injunctions, known as Rule 39 orders, because they are not technically part of international law.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Mr Raab, who is responsible for changes to constitutional laws, said: &#8220;The Bill of Rights will strengthen our UK tradition of freedom, whilst injecting a healthy dose of common sense into the system.<\/p>\n<\/div>\n<\/div>\n<div id=\"piano-inline2\"><\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;We will be very clear in domestic law that Rule 39 interim orders do not bind UK courts or indeed public bodies or officials.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-dm4ypg-ComponentWrapper-HeadlineComponentWrapper e1xue1i89\" data-component=\"subheadline-block\">\n<h2 id=\"Collision-course\" class=\"ssrcss-y2fd7s-StyledHeading e1fj1fc10\"><span role=\"text\">&#8216;Collision course&#8217;<\/span><\/h2>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">The government&#8217;s proposals, unveiled in December, have been criticised by lawyers as confusing and arguably unnecessary, because British courts can already ignore rulings from Strasbourg.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Shadow attorney general Emily Thornberry questioned whether the move would actually change anything, or rather add &#8220;more and more layers of bureaucracy on the application of the Human Rights Act&#8221;, so it will merely &#8220;gum up the system&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">She said: &#8220;They&#8217;re just trying to think of anything that they can take on at the moment in order to distract us all from what&#8217;s really happening, which is their inability to govern &#8211; they&#8217;re trying to pick yet another fight,&#8221; she told the BBC.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Law Society president I Stephanie Boyce, who represents solicitors, said the package was on a collision course with the rest of the law.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;The bill will create an acceptable class of human-rights abuses in the United Kingdom,&#8221; she said.<\/p>\n<\/div>\n<\/div>\n<div id=\"piano-inline3\"><\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;It is a lurch backwards for British justice. Authorities may begin to consider some rights violations as acceptable, because these could no longer be challenged under the Bill of Rights, despite being against the law.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;Overall, the bill would grant the state greater unfettered power over the people, power which would then belong to all future governments, whatever their ideologies.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">Sacha Deshmukh, Amnesty International UK&#8217;s chief executive, said the legislation would represent &#8220;a giant leap backwards for the rights of ordinary people&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;Ripping up the Human Rights Act means the public is being stripped of its most powerful tool to challenge wrongdoing by the government and other public bodies.<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i86\" data-component=\"text-block\">\n<div class=\"ssrcss-7uxr49-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph eq5iqo00\">&#8220;This is not about tinkering with rights, it&#8217;s about removing them,&#8221; he said.<\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The European Court of Human Rights block on sending asylum seekers to Rwanda could be overturned by ministers under new proposals.
