{"id":34741,"date":"2023-06-06T12:10:27","date_gmt":"2023-06-06T12:10:27","guid":{"rendered":"https:\/\/www.nsemgh.com\/?p=34741"},"modified":"2023-06-06T12:10:37","modified_gmt":"2023-06-06T12:10:37","slug":"ghana-police-fined-gh%c2%a2100k-for-ignoring-rti-commissions-orders","status":"publish","type":"post","link":"https:\/\/www.nsemgh.com\/2023\/06\/06\/ghana-police-fined-gh%c2%a2100k-for-ignoring-rti-commissions-orders\/","title":{"rendered":"Ghana Police Fined GH\u00a2100k For Ignoring RTI Commission\u2019s Orders"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Ghana Police Service has been fined GH\u00a2100,000 for its refusal to comply with the Right to Information (RTI) Commission\u2019s directives, which required granting an applicant access to requested information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Commonwealth Human Rights Initiative (CHRI), Africa, had sought information on the status of cases involving police brutality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite addressing the request to the Inspector General of Police, the Police Service completely ignored it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The RTI Commission in a statement highlighted the Respondent\u2019s failure to make decisions on the applicant\u2019s request, along with their disregard for the Commission\u2019s letter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cBased on the Respondent\u2019s failure to make decisions on the Applicant\u2019s application lodged with it, the Respondent has clearly failed to perform its obligation under Act 989. This is coupled with its failure to respond to the Commission\u2019s letter received by it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSuch a posture by the Respondent is not to be encouraged as it is an affront to the right of access to information enshrined under Article 21(1) (f) of the 1992 Constitution of Ghana and affirmed by Act 989 and same ought to be disapproved in strong terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cFor this reason, an administrative penalty of GH\u00a2 100,000.00 is imposed on the Respondent and this shall be payable to the Commission not later than 14 days after receipt of this decision of the Commission by the Respondent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe penalty so imposed shall attract an additional default penalty rate of l0% on the principal penalty sum of GH\u00a2100,000.00 in the event of default for any additional 14 days thereafter.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Ghana Police Service has been fined GH\u00a2100,000 for its refusal to comply with the Right to Information (RTI) Commission\u2019s directives, which required granting an applicant access to requested information.
