{"id":35513,"date":"2023-06-29T09:26:44","date_gmt":"2023-06-29T09:26:44","guid":{"rendered":"https:\/\/www.nsemgh.com\/?p=35513"},"modified":"2023-06-29T09:26:54","modified_gmt":"2023-06-29T09:26:54","slug":"uk-plan-to-send-asylum-seekers-to-rwanda-illegal-court","status":"publish","type":"post","link":"https:\/\/www.nsemgh.com\/2023\/06\/29\/uk-plan-to-send-asylum-seekers-to-rwanda-illegal-court\/","title":{"rendered":"UK: Plan to send Asylum seekers to Rwanda illegal- Court"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Three senior judges have ruled that it is unlawful for the UK government to send asylum seekers to\u00a0Rwanda\u00a0to have their claims processed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court of appeal ruling from Lord Burnett, Sir Geoffrey Vos, and Lord Justice Underhill follows a four-day hearing in April against a high court\u00a0ruling\u00a0last December that found it was lawful to send some asylum seekers, including small boat arrivals, to Rwanda to have their claims processed rather than dealing with their applications for sanctuary in the UK.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The illegal migration bill, now passing through parliament, states that all asylum seekers arriving via \u201cirregular means\u201d could face being forcibly removed to\u00a0Rwanda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those who supported the appeal against the ruling include the UN\u2019s refugee agency (UNHCR), lawyers, charities and a group of asylum seekers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court heard from UNHCR that Rwanda had a record of human rights abuses towards refugees within its borders, including refoulement \u2013 forced removal to countries where they are at risk \u2013 expulsions and arbitrary detention. The refugee agency warned that the\u00a0Home uOffice\u00a0would not be able to guarantee the safety of asylum seekers who were deported to the east African country.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Sir James Eadie KC, counsel for the home secretary, said she was confident that the government of Rwanda would abide by undertakings given in a memorandum of understanding signed by the two countries.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Three senior judges have ruled that it is unlawful for the UK government to send asylum seekers to\u00a0Rwanda\u00a0to have their claims processed.
